APPEALS-Per Rule3(b)-Procedure of the Yurok Tribal Court Rules regarding Appeals: Where a trial court has not set an appellate schedule an appeal must be filed within ten (10) days from the decision of the trial court. If said decision is not made in open court with the parties present or having been ordered to be present the appeal must be filed within twenty (20) days of the decision

TO FILE A REQUEST FOR A TEMPORARY RESTRAINING ORDER FOR CIVIL HARASSMENT: Completely fill out the Request for a Temporary Restraining Order for Civil Harassment form. Also fill out the DV600 form. Bring or send these forms to the Yurok Tribal Court for filing. The Court Clerk will forward them to the Tribal Court Judge for review. The Tribal Court Judge determines if there is sufficient information to order a Temporary Restraining Order for Civil Harassment. If Judge has determined there is sufficient evidence for a Temporary Restraining Order for Civil Harassment, the Court Clerk will then issue a Notice of Hearing and Temporary Restraining Order for Civil Harassment. This Order will contain a court date for both parties to be present.

TO ANSWER A TEMPORARY RESTRAINING ORDER (EITHER FOR CIVIL HARASSMENT OR DOMESTIC VIOLENCE): Fill out the appropriate ANSWER TO A TEMPORARY RESTRAINING ORDER and serve it on the other party. File a copy with the Court Clerk. Provide PROOF OF SERVICE with the ANSWER when filing.

How to Answer a Temporary Restraining Order Civil Harassment

TO FILE A REQUEST FOR A TEMPORARY RESTRAINING ORDER FOR DOMESTIC VIOLENCE: Completely fill out the Request for a Temporary Restraining Order for Domestic Violence. Also fill out the Description of Abuse form. Also complete a DV600 form. File with the Court Clerk. The Tribal Court Judge will review the request and if there is sufficient evidence, the Tribal Court Judge will order a Temporary Restraining Order for Domestic Violence. The Tribal Court Clerk will prepare a Notice of Hearing and Temporary Restraining Order for Domestic Violence. This Notice of Hearing will contain a Court Date. Both parties need to be present at this hearing. The Court Clerk will forward copies to Yurok Tribe Public Safety for service. Also the Court Clerk will forward a copy to the Humboldt County Superior Court for filing in that court under the Family Law Division. This will enter the Temporary Restraining Order into the CLETS system for access through all law enforcement agencies.

FOR DIVORCE OR DISSOLUTION ACTIONS: Completely fill out the Petition and Summons. File with the Court Clerk's Office at the Yurok Tribal Court, 190 Klamath Blvd., Klamath, CA. Mailing Address: P.O. Box 1027 Klamath, CA 95548 There is a filing fee of $25.00. After filing with the Court Clerk, you must hae the Petition served on the spouse. This can be done by anyone over the age of 18 years but not the Petitioner. Also return the completed Proof of Service of Summons to the Clerk's office after service is completed. Complete and serve Financial Disclosures. Depending on the progress of the case, different actions might be taken. The progress of the case may depend on child custody, visitation, child support and financial considerations.
